you and gambling..and it is exist in the eyes of law..watch out!!~

gaming....gambling...gaming...gambling....or dying!!~
which one do u prefer?

Gambling can be addictive when they live as ur heart in ur life and not all gambling is illegal. whether or not gambling as an offence, it is depends on the conditions in which the game is played. Gaming also can be describe as a gambling and the offence that can be carried on in a public place or common gaming house. the types of gambling which are prohobited under the common gaming house act 1953 are bankers games,other gamesand other non-scheduled games which are games chance or mixed chance an skill.
There also has an authorithy by give a warrant that police officer possess where he can enter and search a place that he believe the house is kept or used as a common gaming house:
a. enter and search such a place and all persons found therein.
b. detain all persons found at the place until the place is searched.
c. seize any instruments or appliances, money, securities for money, and other reasonably supposed to have been used or intended to be used for any games or lottery and which may be found at the place or on any person found therein.

for those who are mad in love with gaming badly, be careful with what kind of gaming that you are playing of because there still has a limit where not all gaming can give benefit to us but some of them just make our life become worst, terrible, terrible and miserable....

you and the law relating to cruelty to animals & owning and keeping dogs

this post special for those who love to keep the animals as their pets or for those that love dogs...fact, the animal matters is exist in the eyes of laws where nobodys can deny their right.


Animals also one of the greatest creation made by Allah S.W.T where we need to care them as well as a one of the living things in this world. So that, some kind of cruelty attitude towards the animals shall be avoid because there will be a law that can protect them if you abusing them!!
I. Cruelty to animals.
The law that governing this matters is Animals Act 1953 (Act 647) where the cruelty animal can be describe in the context as any living creatures other than a human being and includes any beast, bird, fish, reptile or insect whether wild or tame. There has types to cruelty to animals are punishable under the Animals Act 1953 where
1. Any individual who kicks, beats, ill-treats, over-rides, over drives, overloads, tortures infuriates or terrifies any animal or being an owner permits any animal used to be.
2. Any individual being in charge of any animal in confinement or in course of transport from one place to another neglects to supply such animal with sufficient food or water
3. Any individual that cause any unnecessary pain or suffering to any animal or being the owner permits any unnecessary pain or suffering to any animal.
4. Any individual who cause an injury towards the animal such as the animal suffering from any diseases, infirmity wound, sore or as they are employed to keep and manage them.
5. Any individual that cause procures or assist at the fighting or baiting of any animal
6. Any individual who keeps, uses, manages or acts or assist in the management of any premises or place for the purpose of fighting or baiting any animal or any person who permits any premises to be so kept, manage and used.
7. Any individual that receives money for the purposes of fighting and baiting in any animals.

II. Owning and keeping dogs
In order to keep and own dog a license is necessary because the law provides that no one shall own, keep, harbor or maintain any dog that is over 3 months old. The consequences for keeping and owning the dog without license can be fine of RM 100.
As the nature of dog is wild and dangerous, it may harm the people around us and there an offences where the law provides that any person who without lawful excuse sets on ur urges any dog to attack or put in fear any person shall be liable to a fine RM 100.


so......treat the animals as the living things too..=)

you and......the Adoption Law.

child here means an unmarried person under 21 years old and includes a female under that age who has been divorce.who may adopt a child?
1.an individu who attained 25 years old or at least 21 years old older than the child to be adopted unless the court satisfied when there has special circumstances for granting the order.
2.an individu attained 21 years old and relative to the child.
3.the parents of the child.
there are several legal requirements for adopting a child which are:
the appilicant and the child to be adopted must be resident in west malaysia, the child is already under the care and possesion for at least 3 consecutive month immediatelypreceeding the date of the order, the intention to apply for an adoption order must be 3 months before the date of the order informed by the social walfare and consent must be obtained from the guardian.
the court must consider before granting the adoption order on several reasons which are the parents who give the consent understand that the effect of the adoption order, the order made must be for walfare of the child and no payment or other reward has been made or agreed upon as a consideration unless court sanction.
so......any of u who want to adopt a child..u must possess this several requirements...=)

Drug Offences

Nowadays, we’ve heard lot of cases regarding drug…our Malay people is taking a drug, as well as our Malay people selling, and distributing the drugs. And this has encourage me to share a little info about drug in law. Drug abuse is a self administration of drug for non-medical reasons in quantity and frequency which may impair an individual’s ability to function effectively and will be very harmful. Drug dependent is a person who through the use of any dangerous drug undergoes a physic and sometimes physical state which is characterized by behavioural and other responses. You have to be clear with few common dangerous drug that can be easily get. They are heroin(most powerful drug), morphine, cannabis( a small rolls wrapped in a brown paper), ketamine ( can be in the form of white powder, liquid, or tablet), estacy, ice/syabu. It is an offence if you are found consuming or trafficking in any of them(the dangerous listed in the First Schedule of the Dangerous Drug Act 1952). Drug offence is either punishable with deth, imprisonment for more than 5years. It is depend on the types, and weight of the drug found with him. If foreigners are found transiting drugs, they shall be liable on conviction to a fine not exceeding twenty thsnd ringgt or imprsnmnt for a term not exceeding 5years, or both.

Law On Computer Crimes…~

There is an act on the misuse of the computer. A computer is an electronic device which means a lot I our life as it is the latest technology. It brings advantages, but beware when using it bcuz it also bring disadvantages when we misuse it. The following offences are punishable under the Computer Crime Act 1997 :
• unauthorized access to computer materials
• unauthorized access with intent to commit or facilitate the commission of further offences
• unauthorized modification
• wrongful communication
• abetments and attempts
• act preparatory to or in furtherance of the commission of offences

So, to those who really eager thing about computer, do limit your ‘experiment’ or else, u’ll be in a hard time in future. Do not misuse of the technology k………….~

You and the Lawyer…

How far do you know about the lawyer?
They are the person who is trained to give advice about the law and to prepare a law case before being considered by the court. Both the solicitor and advocator is the same person. In order to represent their client, they have to have an exclusive to appear and plead in all court regarding both civil and criminal case. In order to be a lawyer, you must be a qualified person (pass final examination in law), age above 18 years, have a good character etc. You may need to see a lawyer maybe when you are being charge with any offence, you are being arrested, or maybe when you want to file any claim. It is also possible that you may see them to get an advice. There are few services that provided by law..which are defending you, file a claim for you, advising you in matters regarding law, apply a grant letter, and drafting as well as preparing the legal documents. You also may need their help when adopting a child. You may look for them friends, colleagues. We can also get it from directory of lawyers published by the Bar Council since they are not allowed to advertise themselves.

Lawyer’s Responsibilities
He must carry out his duty with reasonable care, skill, and promptly. They also must act in the best interest of his client. The important is the information given to them must be confidential. They must keep the client informed on the progress, and shall not accept any case unless he is capable to do it. If you are not satisfied with their service, you just have to inform them, and find another lawyer that you are comfortable with. You can get a free service too by seeking for help from a Legal Aid Centre which run by Bar Council.

defamation..and u have a rights to protect urself~

Defamation…don’t u know that u have a right to protect urself from this kind of situation??


Defamation means the damaging of someone’s good reputation by saying something bad and untrue ‘bout them and has lowered his/her reputation in the eyes of right thinking members of society. It can be in several ways such as spread rumors, try to make a statement via caricature and etc that can damage ur reputation and dignity. Defamation has two types which are libel (written) and slander (oral). There have two courses of action are open when defamation occurs which are suing defamation and criminal defamation. A claimant needs to prove three things in a suit of defamation where the statement was defamatory, the statement also must be referred to the claimant and the statement was published....so..

you and the police

there are few things that we must know about us, and the police. first,  when the policeman in a plainclothes stops u, u have the right to ask him to show you his police authority card. the card is either in blue, yellow, or white in colour, and different colour refers to different level of rank. then, you should know wheter you have to answer in case they ask you a question. there are few ways how to know whether you are under arrest or not. first is when the police mentioned it to you, when police uses force to restrain an individual, and lastly by words or conduct. you can ask the police too whether you are under arrest or not. remember that when you are called for recording a witness statement, do tell the truth and you also have the right where you can ask a lawyer to accompany, ask interpreter's service(in case you do not understand), and lastly make any corrections or change before signing.the police can detained us up to 24hours for investigation. we also have the rights when being arrest and we'll share it with you in the next session. tq~

the talk

last weeks, we were having our day with lawyer and a police..the talk was enjoyable...i only knew that both solicitor & advocater are the same...i thought both of them are different..both the lawyer and police were piss off coz we were late..on that day, i've asked about the Amirul's case...actually i still have one question triggering in my head...i salute mr.Bob since he was very cool n the police was being lil funny since he was hit by ques from student..

feeling toward the book

we got the book on YOUR RIGHTS AND THE LAW..it was for the idiot(according to miss marina)..hehe....but we never claim ourself an idiot, but we are the newer and no nothing bout the law..we have to take extra care on the book, or our marks will be deducted..so,anis came out wif her great idea "lets wrapped dis bok so that our marks won't be deducted"...it shows how much and seriously we take on every miss marina's word..during the clas that we got the book, we were the last group to get the book..we wait n wait till everyone got the book, then only we raise our hand..during that time, anis keep asking me 'bl kita nk angkat tgn ni'...n i told her 'it's ok..kita tunggu orang len dh dpt dulu'..we thought there's still have a group who still waiting like us, until miss marina need to repeat twice "who didn't get your book? raised up your hand"..and then only we realized, only 1 group more left-OUR GROUP...dats why we joined the 'pending club'...anyone who wish to jon this club, you may visi it at the facebook(we are promoting the pending club, so credit to asma n anis)...luckly dis book are not that hard to be understand since the words are not that 'bunga2'...

Introduction

The day of tuesday mark the creation of our blog name asmanyz which is the collobration of the name asma and anis. We are both roommates and classmates. We have been work together since our second semester and the third semester made we more close because we handled the SPR project together. We made a good team as we can go along with each other well.:)
